My landlord verbally told me to move out. Is that an eviction?

Your landlord must give you written notice to terminate your tenancy. Eviction notices cannot be given verbally. A real eviction begins with a written notice, usually for 3, 30, or 60 days. But you do not have to leave your home when this notice expires (unless you live with your landlord*), and your landlord cannot force you to leave or lock you out. If you have not moved by the notice expiration date, the landlord can then begin the court eviction process with a lawsuit. This is called an Unlawful Detainer.

[Please note: For a single lodger, a person who lives in a room in a house where the owner lives, the landlord does not have to go through the court process to evict. Please contact an attorney or tenant counsellor for specific advice.]

What is the eviction process like?

In California, the only way a landlord can legally evict a tenant is by going through the courts and winning an eviction lawsuit. Accordingly, there are a set of legal procedures they must follow to properly evict a tenant. Below is a chart showing the relevant procedures and timeline for an Unlawful Detainer case.

I received a written eviction notice. Now what?

If you received a written eviction notice, please contact the Eviction Defense Collaborative immediately (415) 659-9184 or legal@evictiondefense.org. If you are API, senior, low-income, and non-English speaking, please contact the Asian Law Caucus (415) 896-1701.If you receive a “Summons and Complaint for Unlawful Detainer”, you must respond to this within 5 days, or you will lose automatically and can be evicted by a Sheriff. The eviction process moves very quickly so it is important to find legal help immediately. DO NOT IGNORE an eviction notice or court papers.

What should I do if I receive a Sheriff’s Notice to Vacate?


Contact Eviction Defense Collaborative IMMEDIATELY - Call (415) 659-9184 or legal@evictiondefense.org. If you do nothing, the Sheriff will evict you even if you didn’t do anything wrong.
